The current legal notice (hereinafter, Legal Notice) regulates the use of the website (hereinafter the Website) which is provided to Internet users by TICKET BUREAU, S.L. (with domicile at Rambla de Catalunya, n 89, entresuelo A , provided of tax number C.I.F. B-62.522.289, and registered in the Commercial Registry in Barcelona with the following references Tomo 33.583, folio 212, hoja numero B-230.988, inscripcion 1), hereinafter TICKET BUREAU.
The purchase of tickets using this website implies the acceptance of each and every of the clauses, terms and conditions contained in this legal notice as described below.
The website deals with on-line sales of packages for all types of cultural and sports events held both in Spain and abroad, specializing in those events of greater importance or social repercussion, which are therefore more difficult to obtain.
TICKET BUREAU is a receptive travel agent for international events specialized in obtaining tickets for packages which are especially difficult to obtain for show or events that are sold out. Through our network of contacts and suppliers, we are able to obtain tickets for almost any event in any city. All tickets will be sold at the final price fixed by the promoter plus the Dealing and Management costs incurred by TICKET BUREAU, or in the case of Ticket Exchange events (marked as such in the website) with the added costs of presale, prebookings and commissions freely set by the ticket suppliers.
The use of this website implies the conditions of being a user of it (hereinafter, the User) and implies full and unconditional acceptance of each and every one of the regulations included in this Legal Notice in version published by TICKET BUREAU at the moment that the User accesses the website. Therefore the User should carefully read this legal notice every time he/she decided to use the website, as it could be subjected to modifications.
The USER should abstain from any kind of activity that could be damaging in any way to the website, TICKET BUREAU and/or other users of the same. Should the user fail to comply with any of the aforementioned obligations, TICKET BUREAU reserves the right to prohibit or deny access to the Website of that User.
Duration
In accordance with the terms and conditions of this legal notice, along with the General Contracting Conditions, TICKET BUREAU reserves the unilateral right to temporarily suspend or definitively terminate the provision of services through the website, as well as temporarily or definitively suspending the services of the Website.
Access codes
The access code/ user name/ password are obtained by following the process in use at any time as stipulated in the Website by TICKET BUREAU.
The user should not allow the use of their own access code/ user name/ password to third parties. It is the responsibility of the User to protect and accordingly update the access codes/ passwords. For greater security, TICKET BUREAU recommends that the User should not use the same word for both the user name and password.
TICKET BUREAU accepts no responsibility for any possible damage or prejudices or unobtained benefits by the User, which may have been produced as a consequence of the loss or extraction of the access code/ user name/ password to third parties and/or their use by a third party.
TICKET BUREAU reserves the right to unilaterally modify at any time the system by which users can access the Website.
Copyright and patent rights
TICKET BUREAU is the owner, in totality, of the domain and the Website www.spainticketbureau.com, including without exception, its design, structure and distribution, response to consultations made by users, texts and contents, logos, buttons, images, pictures, source code, as well as copyright and patent rights, and any other distinctive signs, belong to TICKET BUREAU or, in given cases, the people and companies that appear as the authors or owners to the rights. Violation of the aforementioned rights shall be dealt with in accordance with present legislation. Reproduction, or the total or partial exploitation, by any means, of the content of the TICKET BUREAU website for uses other than the legitimate information and contracting by users of the offered services is strictly forbidden.
TICKET BUREAU accepts no responsibility in any respect for copyright and patent rights belonging to third parties that are infringed by a third party or user.
Use of cookies
In order to control user sessions, www.spainticketbureau.com uses cookies when they navigate the site. The cookies are temporary, i.e. they disappear at the end of the session. Therefore, this cookie is not stored in the hard drive and when the user closes the sessions it will not appear. The cookies used cannot read hard drive data or read cookie archives created by other suppliers. The cookies used are harmless and are only used during the user session. To use TICKET BUREAU the user must permit the installation of temporary cookies.
Responsibility for the functioning of service
1.- Limit of responsibility:
The acceptance by the User of the following limit of responsibility is an essential element for the validity of the purchase. Therefore, in the rendering of service, the maximum responsibility assumed by TICKET BUREAU will never be more than the price of the ticket plus a 10 percent (all the managing and transport costs included). Consequently, if an error or negligence can be proved, the indemnification will never be an amount bigger than the one indicated above. Besides, TICKET BUREAU will not be responsible for damages for loss of profits.
2.- Deliverance of tickets:
TICKET BUREAU will proceed with the maximum diligence contracting a good deliverance service so as to provide the user, in time and form, with the purchased tickets and complementary documentation.
In case we can not delivery the tickets to the clients in hand, the tickets will be delivered at the porter's lodge (in a private house) or at the reception of the client hotel. The porter or the concierge will be responsible to hand over the tickets delivered by TICKET BUREAU to the client, so the client will accept our receipt with the signature of the porter/concierge and the stamp of the hotel as a valid delivery receipt. The user can also select collect the tickets at our office.
Tickets for all types of events are subject to availability. Owing to the nature of our work, tickets can be supplied on the same day as the event In the case of purchase of several tickets for the same event; we cannot guarantee that they will be located alongside each other, or even in the same row or section.
However, TICKET BUREAU will not be responsible for the lack of deliverance caused by incomplete or erroneous information provided by the User or in any case of major force.
As an example, the following circumstances can be considered as major force cases:
* Irremediable and unpredictable deficiencies in the internal functioning of the mail and transport services contracted by TICKET BUREAU, notwithstanding the fact that TICKET BUREAU will do its best efforts to provide User with tickets in time and form.
* The robbery or damage in the tickets while they are being transported, as a consequence of unpredictable causes out of TICKET BUREAU'S control.
* Weather conditions that could affect the travel to or from the place whre the event takes place.
In case the client selects the option to pick up the tickets at the Event Ticket Boxes, it is solely the client's responsibility to go to the Ticket Boxes in question from 2 hours before the Event starts and have personal identification ready.
It is the client's sole responsibility to fulfil the terms of use, conditions and attire imposed by the venue, such as dress code.
3.- Timetables and Transportation:
The date and time of the matches are only confirmed 10-5 days before the event by the respective Sports Federations in the country where the event is held. It is the user's sole responsibility to check the confirmed date and times of the match. TICKET BUREAU will not be liable for events changing times or dates from the original estimate. Furthermore, it is the client’s sole responsibility to arrange for proper transportation to the venue where the event is to be held at the confirmed date and time.
4.- Impossibility of obtaining tickets:
If the tickets required by the client cannot be obtained, TICKET BUREAU reserves the right to obtain instead tickets belonging to the immediately higher or lower category (with the consequent return of the proportional cost) depending on availability, or to cancel the purchase order with no further obligation than the return of the cost paid.
TICKET BUREAU shall make every effort to obtain the ticket requested, but cannot guarantee, in any way, that it will obtain from the Promoter said tickets, or accept responsibility for any failure to do so. Should such a circumstance arise, TICKET BUREAU will have the sole obligation of returning the quantity paid for the tickets that could not be obtained.
Should TICKET BUREAU obtain the ticket and, afterwards, the event is canceled, suspended or modified, this will be of the exclusive responsibility of The Promoter, as indicated above. TICKET BUREAU will only compromise itself to return the price of the ticket.
IMPORTANT: All orders paid with using American Express credit card will be definitive; these orders can not be cancelled or refunded.
5.- Exemption of responsibility for functioning of the web site:
TICKET BUREAU does not guarantee that the web site will constantly be dependably and correctly functional, without delays or interruptions, and therefore TICKET BUREAU takes no responsibility for damage or prejudice caused by possible unavailability or technical discontinuity of the web site.
TICKET BUREAU accepts no responsibility for any damage and/or prejudice and/or unobtained benefit by the user or any damaged third party as a result of any uncontrollable circumstance, any incident, failure or error of communication systems, or defective service supply or Internet failure.
TICKET BUREAU does not guarantee that the content of the Portal will always be up to date, nor that the content contributed by users or training centers will observe laws, morals, good faith and/or decent behaviours, or that they do not contain some kind of error, such that TICKET BUREAU accepts no responsibility for any damage and/or prejudice and/or unobtained benefit by the user or any damaged third party as a result of the same.
TICKET BUREAU accepts no responsibility for any damage and/or prejudice and/or unobtained benefit by the user or any third party caused directly or indirectly by connection and/or use and/or access to the web site or pages linked to it, and is therefore not responsible for any damage and/or prejudice and/or unobtained benefit by the user or any third party for the following causes:
# Incorrect functioning, defects, failures and/or damage caused totally or partially to the user's hardware or software.
# Loss, alteration and/or total or partial damage of information contained in magnetic supports, discs, tapes, floppy discs and others, as well as the introduction of computer viruses or unwanted variations or alterations of all information, documents, files, databases, hardware and/or software.
6.- Additional warnings:
6.1.- Please, confirm the data inserted is correct. After your confirming it, no further modifications are possible.
6.2.-The cost incurred by TICKET BUREAU as a consequence of the obtention of tickets already sold will be necessarily reflected in the final price. Thus, final prices may vary subject to availability.
6.3.- In case of nominative tickets, TICKET BUREAU will not be responsible if the access to the spectacle is denied by the Promoter. In this sense, the Promoter reserves the admission right and will be entitled to register the public at the entrance.
6.4.- TICKET BUREAU displays different Labels for tickets offered on the website. These labels clarify the pricing and commissions that apply for that event. TICKET BUREAU offers several kinds of tickets, always indicated by the event Label: "tickets at face value", "ticket office price", "tickets with a 20percent commission", "tourist package ticket" (ie including one or several of the following: hotel reservation, sightseeing bus, shuttle transport, stadium tour...) and more. For "Ticket exchange" events, TICKET BUREAU does not act as an official ticket agent but as an online marketplace where other suppliers can offer their tickets. The prices of the tickets on sale in Ticket Exchange events might be not at face value price as the suppliers can freely set the commission they want to earn.
7.- Applicable law and legal responsibility:
The user or training center accepts that the legislation applicable to the functioning of this service is Spanish Law, as TICKET BUREAU operates from Spain and it shall be the legal authorities and courts and tribunals of place where the obligations must be complied that shall resolve any divergences derived from interpretation or application of this clause.
8 .- Cancellation policy
Cancellations of tickets and other services purchased from Ticket Bureau will only be carried out if the Money Back Guarantee has been added to the order. Not all event tickets offer the money back guarantee option. TICKET BUREAU states clearly all events which are eligible for this service. For events not eligible for the Money Back Guarantee or if the customer has not purchased this service with their tickets, TICKET BUREAU has the final decision as to whether or not the order may be cancelled and refunded. If the cancellation is accepted, there will be a minimum 10% of cancellation fees retained by TICKET BUREAU from the total amount paid.
